Abstract
Current industrial capitalism has shifted several traditions of society including the issue of
the roles and responsibilities of men and women in the family. At present men and women
both have the opportunity to work in various sectors, both government and private, this
reality has provoked demands for equal rights of men and women for inheritance rights in
the family. From that the writer is interesting to discuss the role of men and women in the
family and their respective inheritance rights according to Islam. The approach used in this
discussion is philosophical normative, which is to explore the legal basis of the position of
men and women in the family and their respective rights and responsibilities. Furthermore,
it also explores the philosophical value of the different inheritance rights of men and
women according to Islam

Abstrak
Kapitalisme industri yang berlangsung dewasa ini telah menggeser beberapa tradisi
masyarakat termasuk masalah peran dan tanggung jawab laki-laki dan perempuan dalam
keluarga. Saat ini laki-laki dan perempuan sama-sama mempunyai peluang bekerja di
berbagai sektor baik pemerintah maupun swasta, realitas ini telah memancing tuntutan
kesamaan hak laki-laki dan perempuan terhadap hak waris dalam keluarga. Dari itu
penulis menarik untuk membahas peran laki-laki dan perempuan dalam keluarga serta
hak waris masing-masing menurut Islam. Pendekatan yang digunakan dalam pembahasan
ini adalah normatif filosofis, yaitu menggali dasar hukum kedudukan laki-laki dan
perempuan dalam keluarga serta hak dan tanggung jawab masing-masing. Selanjutnya
juga menggali nilai filosofis dari perbedaan hak waris laki-laki dan perempuan menurut
Islam.
