PENENTUAN MAHAR DALAM ADAT MASYARAKAT ACEH MENURUT PERSPEKTIF FIQH SYAFI‘IYAH

Abstract
Determination of dowry which is rather high in some areas be a problem for some people,
especially for those who are domiciled in place dowry is rather low. Therefore, the authors
wanted to examine the issue Syafi'iyah fiqh perspective. The reason is, because almost all
of the people of Aceh Shafi adherents in the field of practical amaliyah. After all the data
collected, the authors conducted an analysis turned out to indigenous people of Aceh in
terms of determining the legality of dowry received recognition in the law of Shari'ah fiqh
Syafi'iyah that they follow. And according to the theory of Shafi, in principle, the Acehnese
practice that has prevailed for generations do not exist to the contrary. However, makruh
legal because it does not follow the Sunnah of the Prophet. So therefore, researchers are
looking forward to the community, not again protested dowry determination rather high in
part because the indigenous people of Aceh is already get a syar'i legality.
