Divorce is the breakdown in the relationship between married couples, so that all the
implications thereof will apply to married couples who do divorce. In its
implementation, especially in divorce divorce is granting the divorce the husband
absolutely. But it's not that those rights could be used arbitrarily. In terms of in time
at any time, at any place. By their husbands in dropping the divorce. There are
important things that become part of a process of divorce, i.e. witnesses. Witnesses
here not only a witness in the narrow sense. However, witnesses are witnesses who
provide a vital role in the process of a smooth, legality as well as the benefit of a legal
action. In conventional fiqh, the presence of a witness is not too important in divorce.
However, in its application, namely positive law-legislation-in force in Indonesia is
an interesting phenomena to be examined. It gives the opportunity to the compilers to
unveil how the view of Islamic law against the existence of the testament of a
divorced divorce in Mahkamah Syar'iyah Lhokseumawe. Formulation of the problem
to the study was ١) How the position of a witness in the divorce issue in the
Mahkamah Syar’iyah Lhokseumawe?, ٢) how Islamic law about the position of a
witness in the divorce issue in the Mahkamah Syar’iyah Lhokseumawe?, the purpose
of this research is to ١) to know and explain the position of the witness in the matter
of divorce in Mahkamah Syar’iyah Lhokseumawe. ٢) to analyze how the view of
Islamic law concerning the position of a witness in the divorce issue in Lhokseumawe
Court of Syar'iyah. The type of research that the researcher use leads to research that
are descriptive which is non research hypothesis. In this study researchers sought to
describe and analyze several cases concerning a witness in a case of divorce in the
Syariah Court of Lhokseumawe. Results of the study are as follows: the plaintiff for
divorce the plaintiff must bring witnesses forward trial, engenai criteria which must
be owned by a witness to be able to have the properties fair, said the judge did not see
it from the criteria expressed by Scholars who generally should avoid major sins, not
continuously do little sins, The position of the witness in divorce cases in the Court of
Lhokseumawe syar'iyah is to strengthen the plaintiffs or defendants, but the position
of the witness to determine an application is granted or denied, it is also in
accordance with the judicial system in Islamic law because in Islamic law the witness
also considered as evidence.
